"Clochee Skinstory Club”

 

§ 1.
General Provisions

1. These terms and conditions (hereinafter: "Terms and Conditions") define the conditions for participation in the "Clochee Skinstory Club" loyalty program (hereinafter: "Program" or "Club").
2. The Organizer of the Program is Clochee Sp. z o. o. with its registered office in Szczecin at ul. Aleja Wojska Polskiego 14/U1, 70-471 Szczecin, registered in the District Court – Centrum in Szczecin, XIII Commercial Division of the National Court Register. Share capital in the amount of PLN 4,001,000 fully paid up. KRS: 0000470899, NIP: 852-260-34-57, REGON: 321395694 (hereinafter: "Organizer").
3. Contact with the Organizer is possible via:

4. The condition for participation in the Program is to have read these Terms and Conditions beforehand.

 

§ 2.
Definitions

1. Terms used in the Terms and Conditions written with a capital letter, which have not been otherwise defined in the content of the Terms and Conditions, have the following meaning:
     a) Points – points collected by Participants entitling them to receive Rewards. The conditions for awarding Points to Participants are specified in the Terms and Conditions;
     b) Organizer's Store – the online store run by the Organizer at: www.clochee.com
     c) Organizer's Store Terms – the terms and conditions of the Organizer's Store available at: https:/clochee.com/terms
     d) Participant – a person who has joined the Program or has taken actions aimed at joining the Program;
     e) Reward – a benefit that the Participant can receive in exchange for collected Points, in particular discount codes intended for use in the Organizer's Store;
     f) Marketing Consents – consents granted by the Participant to receive commercial information (including offers) and other marketing content regarding the Organizer's Store, provided by the Organizer via e-mail, SMS messages, and telephone calls.
2. Terms used in the Terms and Conditions written with a capital letter, which have not been defined in section 1 above or in the content of the Terms and Conditions, have the meaning given to them in the Organizer's Store Terms.
3. In matters not regulated in these Terms and Conditions, the provisions of the Organizer's Store Terms shall apply.

 

§ 3.
Club Participation Conditions

1. Participation in the Club is voluntary.
2. The Organizer does not charge Participants any fees for participating in the Club.
3. A Participant may only be a natural person with full legal capacity who is a Consumer.
4. A condition for participation in the Club is for the Participant to have an active Account in the Organizer's Store.
5. Participation in the Club requires the Participant to provide Marketing Consents. The Participant may withdraw granted Marketing Consents at any time, with the reservation that the effect of withdrawing Marketing Consents is the suspension of the possibility of collecting Points and their exchange for Rewards.
6. Received Points and Rewards are not exchangeable for a cash equivalent.
7. A Participant may not transfer the benefits resulting from participation in the Club to a third party.
8. In order to join the Club, the Participant should log in to the Account in the Organizer's Store;
9. The Participant joins the Club upon clicking the button confirming joining the Club. Upon joining the Club, the Participant receives a welcome message and gains access to the Club panel, available at the link: https://clochee.com/login/

 

§ 4.
Collecting Points

1. After joining the Club, a Participant with active marketing consents gains the possibility to collect Points.
2. The number of Points collected by the Participant depends, in particular, on the participation level held by the Participant at the time of performing the activities for which they can receive Points.
3. The following participation levels are distinguished in the Club:
     a) Level 1 - The Participant reaches this level when the total number of points accumulated on the customer account exceeds 1,500.

     b) Level 2 - The Participant reaches this level when the total number of points accumulated on the customer account exceeds 3,000.

     c) Level 3 – The Participant reaches this level when the total number of points accumulated on the customer account exceeds 6,000.

    Due to the necessity of verifying the fulfillment of conditions, the status (level) is granted within 14 days from the moment the conditions for receiving it are met. 

4. When determining the level of participation in the Club, the Organizer takes into account only Orders placed by the Participant after joining the Club.
5. Points for activities performed by the Participant are converted by the Organizer within up to 7 business days. 


6. For Orders placed in the Organizer's Store, the Participant receives Points according to the following rules:
     a) the number of Points received by the Participant for placing an Order is equivalent to the value of the purchased product, i.e., PLN 1 is 1 Point in the Program.
8. A Participant may also receive Points for:
     a) submitting a Product Rating – 10 Points;
     b) submitting a Product Review with text – 20 Points;

     c) submitting a Product Review with a photo – 30 Points;
     d) submitting a Review of the Organizer's Store and order – 20 Points;
     e) participating in a survey conducted by the Organizer – up to 100 Points;
     f) signing up for the Organizer's store newsletter database – 100 Points          
9. Due to the necessity of verifying the correctness of the Points calculation, the Points collected by the Participant are subject to activation within 14 days.
10. The Organizer is entitled to organize special campaigns, under which it may award Participants additional Points (including for activities not listed in the Terms and Conditions). Points collected by Participants as part of special campaigns are subject to activation within the time limits specified in section 9 above, and in the case of activities not mentioned in the Terms and Conditions – within 14 days from the day of performing these activities by the Participant.
11. The Organizer reserves the right to suspend the awarding of points during special promotional campaigns in the clochee.com store. 

12. Exceptionally, at the customer's request, the Organizer may add to their account points collected in other versions of the program, provided that verification is possible. Points from previous editions of the program are not automatically transferred to the current one. 

 

§ 5.
Exchanging Points for Rewards and Discount Tiers

1. The Participant may exchange collected Points for Rewards via the Club panel, available after logging into the Account.
2. The current Rewards catalog is presented within the Club panel and in the Organizer's Store.
3. Only active Points are subject to exchange for Rewards.
4. The exchange of Points for a Reward is irreversible.
5. The Participant (regardless of the participation level held) may exchange Points for a Reward in the form of a discount code lowering the price of an Order in the Organizer's Store (hereinafter: "Monetary Reward") by:
     a) PLN 10 – in exchange for 500 Points,

     b) PLN 20 – in exchange for 800 Points, 
     c) PLN 30 – in exchange for 1,000 Points,

     d) A one-time discount code for –50% off the retail price of products and a surprise reward, determined by the Organizer, in exchange for 9,000 Points.

6. After exchanging Points for a selected Reward, the Organizer sends the Participant the relevant discount code via e-mail. The message with the discount code referred to in the preceding sentence also specifies the validity period of the discount code during which the Participant may use it.
8. If the Participant fails to use the discount code before its expiration date, the discount code expires upon that date.
9. In case of failure to receive the selected Reward, the Participant is obliged to contact the Organizer immediately. The Organizer is not responsible for the consequences of the lack of contact on the part of the Participant regarding the Reward, nor for the effects of automatic redirection of the message with the Reward to the SPAM folder by the Participant's e-mail filters.
10. Using the Reward consists of the Participant entering the received discount code in the form used to place an Order in the Organizer's Store, and then placing and paying for the Order (hereinafter: "Reward Collection").
11. Within the same Order, the Participant may use only one Reward.
12. The Participant may use the received Reward only once. Reusing the same Reward with the same discount code is impossible.
13. Reward Collection does not combine with other discount codes, promotional campaigns, or electronic gift cards.

14.  After accumulating the appropriate sum of Points on their customer account, the Participant may receive a permanent discount for orders:

     a)  with a number of Points exceeding 1,500, the Participant will receive a –7% discount on the order price in the Organizer's store.
    b)  with a number of Points exceeding 3,000, the Participant will receive a –10% discount on the order price in the Organizer's store.

    c)  with a number of Points exceeding 6,000, the Participant will receive a –15% discount on the order price in the Organizer's store.

15. In the event that the Participant uses Points accumulated on the account to realize a Reward, their pool of Points is reduced by the adequate number, equal to the value of the Reward used. 

 

§ 6.
Procedure in Case of Violations

1. In the event of a breach of the Terms and Conditions or the Organizer's Store Terms by the Participant (including obtaining Points or Rewards in an unauthorized manner), the Organizer is entitled to withdraw active Points and Rewards that have not been used by the Participant.
2. The Organizer shall notify the Participant of the withdrawal of Points and Rewards and the reason for their withdrawal via e-mail. Independently, information about the withdrawal of Points and Rewards is placed in the Club panel.

 

 § 7.
Resignation from Participation in the Club

1. A Participant may resign from participation in the Club at any time by:
     a) deleting the Account in the Organizer's Store – in such a case, participation in the Club ceases upon deletion of the Account;

     b) sending a resignation from participation in the Club to the Organizer's e-mail address indicated in § 1 section 3 point 1 of the Terms and Conditions – in such a case, participation in the Club ceases upon positive consideration of the resignation by the Organizer.
2. Resignation from participation in the Club results in the automatic expiration of Points accumulated by the Participant at the time participation in the Club ceases. For expired Points, the Participant is not entitled to a cash equivalent or any other benefits from the Organizer.
3. After resigning from participation in the Club, the Participant may join it again, with the reservation that re-joining the Club does not involve receiving "start" Points.


§ 8.
Complaints

1. In the event of irregularities regarding the Program, the Participant has the right to file a complaint.
2. The complaint is submitted via e-mail to the address indicated in § 1 section 3 point 1 of the Terms and Conditions.
3. The complaint should contain at least:
     a) the Participant's name and surname;
     b) the Participant's e-mail address;
     c) the Participant's telephone number;
     d) a brief description of the reasons for submitting the complaint, including observed irregularities related to the Program.
4. In the case of submitting a complaint that does not contain all the elements indicated in section 3 above, the Organizer may ask the Participant to supplement the complaint. If the complaint is not supplemented, the Organizer is entitled to leave it without consideration.
5. The Organizer shall provide a response to the complaint via e-mail, no later than within 14 (fourteen) days from the date of its receipt in a correct and complete form.
6. The Organizer's decision to accept or reject the complaint is final and no appeal can be made against it.
7. Filing a complaint does not exclude the Participant's possibility of pursuing claims based on generally applicable law.

 

 § 9.
Dispute Resolution

1. The Participant has the option of using out-of-court methods for dealing with complaints and pursuing claims.
2. Detailed information regarding the Participant's possibility of using out-of-court methods for dealing with complaints and pursuing claims, as well as the rules of access to these procedures, are available at the offices and on the websites of:
     a) district (municipal) consumer ombudsmen and social organizations whose statutory tasks include consumer protection;
     b) Provincial Inspectorates of Trade Inspection;
     c) the Office of Competition and Consumer Protection (UOKiK).

 

§ 10.
Processing of Personal Data

Information on the processing of Participants' personal data can be found in the Privacy Policy available at: https://clochee.com/pol-privacy-and-cookie-notice.html.

 

§ 11.
Amendment of the Terms and Conditions

1. The Organizer may amend the Terms and Conditions in case of:
     a) a change in the Organizer's business object;
     b) a legal obligation to make changes, including the obligation to adapt the Terms and Conditions to the current legal state;
     c) preventing violations of the Terms and Conditions or counteracting abuses;
     d) removing ambiguities or interpretative doubts regarding the content of the Terms and Conditions;
     e) expanding the Program to new communication platforms;
     f) a change in the scope of Participants joining the Program;
     g) a decision by the Organizer to introduce conditions for participation in the Program more favorable to Participants.
2. The Organizer informs about the change of the Terms and Conditions by making the amended version of the Terms and Conditions available in the Organizer's Store and by sending the amended version of the Terms and Conditions to Participants via e-mail.
3. The change of the Terms and Conditions enters into force after 14 (fourteen) days from the day the Participant receives information about the change of the Terms and Conditions.
4. A Participant who does not agree to the change of the Terms and Conditions may resign from participation in the Program in the manner indicated in § 7 of the Terms and Conditions until the changes enter into force.

 

 § 12.
Duration and Termination of the Program

1. The start date of the Program is October 15, 2025.
2. The duration of the Program is indefinite.
3. The Organizer may terminate the Program at any time for an important reason, which is:
     a) a change in generally applicable laws directly affecting the Program and resulting in the necessity of its termination;
     b) economic unprofitability of the Program;
     c) issuance of a judgment or decision by a court or authorized public authority concerning the Program and resulting in the necessity of its termination;
     d) introduction of other forms of promotional and marketing activities concerning the Organizer or the Organizer's Store in place of the Program.
4. The Organizer is obliged to notify Participants of the termination of the Program via e-mail no later than 30 (thirty) days before the last day of the Program.
5. The Participant may exchange Points for Rewards until the last day of the Program. After the end of the Program, unexchanged Points are subject to expiration. For expired Points, the Participant is not entitled to a cash equivalent or any other benefits from the Organizer.

 

 § 13.
Final Provisions

1. The law applicable to these Terms and Conditions is Polish law.
2. The current version of the Terms and Conditions is effective as of October 15, 2025.
